Terms and Conditions

Please read these terms and conditions carefully before using Romy's Garage.

Interpretation and Definitions

Interpretation

The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

  • Application means the software program provided by the Company and downloaded by You on any electronic device, named Romy's Garage.
  • Application Store means the digital distribution service operated and developed by Apple Inc. (the Apple App Store) through which the Application is distributed.
  • Account means the sign-in state created for You to access the Application via Sign in with Apple. For the restoration part, Your Account exists only as a reference to Your Apple ID, stored locally on Your Device, used to unlock access to the Application and to recognize Your Pro Subscription across reinstalls.
  • Car Sharing Account means the account created on Our server, hosted in the European Union, when You start using the optional car sharing part with Sign in with Apple. It holds the data needed to share a car with other members, as described in Our Privacy Policy.
  • Country refers to: Schleswig-Holstein, Germany.
  • Company (referred to as either "the Company", "We", "Us" or "Our" in these Terms and Conditions) refers to Alejandro Morillo Diaz, Am Markt 14, Burg auf Fehmarn, Germany.
  • Device means any device that can access the Service, such as an iPhone or iPad.
  • Service refers to the Application (Romy's Garage).
  • Subscriptions refer to the auto-renewing "Pro" plans (currently offered on a monthly or annual basis) that unlock additional features of the Service, purchased through the Application Store.
  • Project Data refers to the vehicle project information You create within the Application — including project names, categories, parts, tasks, milestones, budget entries, journal entries, before/after photo pairs, and any photos You take or import into the Application.
  • Terms and Conditions (also referred to as "Terms") means these Terms and Conditions which govern Your access to and use of the Service.
  • You means the individual accessing or using the Service.

Acknowledgment

These Terms and Conditions govern the use of this Service and constitute the agreement between You and the Company. These Terms set out the rights and obligations of all users regarding use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access the Service.

Romy's Garage does not run its own age-verification check. Instead, eligibility to use the Service is governed by Apple: You represent that You meet whatever minimum age Apple requires to hold the Apple Account used to sign in and to use the App Store in Your country of residence (including, where applicable, use under a parent- or guardian-organized Apple Account via Family Sharing, subject to Apple's own terms and parental controls).

Your access to and use of the Service is also subject to Our Privacy Policy, which describes how We process information in connection with the Service. Please read Our Privacy Policy carefully before using the Service.

Subscriptions and Purchases

Pro Subscription

The Service is free to use with limited functionality (the "Free" tier — currently one vehicle project with limited photos, parts, and tasks). Additional functionality — including unlimited projects, photos, and before/after comparisons, PDF build reports, and a detailed budget breakdown — is available through an auto-renewing Pro Subscription, offered on a monthly or annual basis as displayed in the Application at the time of purchase.

The Company may introduce additional Subscription durations or one-time unlock options, or change which features require a Pro Subscription, at any time. Such changes will not retroactively reduce access already granted to existing paying subscribers for their then-current, already-paid billing period.

Car Sharing Subscription and Extra Seats

The car sharing part of the Application requires an auto-renewing Car Sharing Subscription held by the person who creates a shared car (the "Owner"). Each subscription level includes a number of car slots, offered monthly or annually as displayed in the Application at the time of purchase; each car includes up to four people. Members who join a shared car with an invite code do not pay. Additional seats for a car can be bought as one-time purchases; a purchased seat stays with that car for as long as the car exists and is not transferable to another car. A free trial may be offered to new subscribers as shown in the Application. If the Owner's subscription ends, the car becomes read-only for all members: entries can no longer be added, but existing balances can still be settled.

Billing, Renewal, and the Apple App Store

All payments, billing, and Subscription renewals are handled exclusively by the Application Store (Apple Inc.), charged to the payment method associated with Your Apple ID. Unless cancelled at least 24 hours before the end of the current billing period, a Subscription automatically renews for an equivalent period at the then-current price. You can view, manage, and cancel Your Subscription at any time on Your Device, under Settings → [Your Name] → Subscriptions.

The Company does not process, collect, or store Your payment card details; this information is handled entirely by Apple under Apple's own terms and privacy policy.

Refunds

Because all transactions are processed by Apple, the Company cannot directly grant refunds. Except where required by applicable law, paid fees are non-refundable by the Company. Any refund request must be submitted directly to Apple Support in accordance with Apple's Media Services Terms and Conditions.

Fee Changes

The Company may change Subscription prices from time to time. Any price change affecting an active Subscription will be communicated to You in advance in accordance with the Application Store's requirements and will require Your affirmative acceptance before it takes effect for Your Subscription.

Your Account

Romy's Garage uses Sign in with Apple to control access to the Application. For the restoration part there is no Company-operated server or account database: the stable, app-specific identifier issued by Sign in with Apple (not Your real Apple ID or email address) is stored securely in Your Device's Keychain and is also shared with Our subscription-management provider, RevenueCat (see Our Privacy Policy), so that Your Pro Subscription can be recognized if You reinstall the Application or sign in with the same Apple ID on another Device.

If You use the optional car sharing part, a Car Sharing Account is created on Our server. You can delete it at any time in the Application under Settings → Car Sharing → Delete Car Sharing Account; what happens to the data of shared cars is described in Our Privacy Policy.

You are responsible for safeguarding the Apple ID credentials You use to access the Service. If You revoke Romy's Garage's access under Sign in with Apple (in Your Apple ID account settings), You will be automatically signed out of the Application.

Your Project Data

Romy's Garage is a local-first application. Unless You explicitly choose to export it (see below), all Project Data You create — including any photos — is stored exclusively on Your Device and is never transmitted to, or accessible by, the Company or any third party.

You retain full ownership of Your Project Data at all times. Because it never leaves Your Device, the Company cannot access, back up, restore, sell, or otherwise process Your Project Data on Your behalf.

Export, Import, and Backups

The Application includes an optional "Export data" feature that creates a backup file (containing Your Project Data and photos) which You can share using Your Device's standard share sheet (for example, to save it in Files, a cloud-storage app of Your choice, or transfer it to another of Your devices) — and a matching "Import data" feature to restore such a file. Whether, where, and how You store an exported backup file is entirely Your decision and Your responsibility; the Company has no access to, and assumes no responsibility for, any backup file You create.

No Cloud Sync; No Guarantee Against Device-Level Data Loss

The Service does not synchronize Your Project Data across devices or to any cloud service operated by the Company. If Your Device is lost, damaged, reset, or the Application is deleted without first exporting a backup, Your Project Data may be permanently and irrecoverably lost. The Company strongly recommends creating a backup export before switching devices or reinstalling the Application and is not responsible for any resulting loss of Project Data.

Car Sharing

The car sharing part is a tool for people who already share a car privately — for example friends, family, flatmates, colleagues, or travel companions. The Company is not a party to any agreement between members, does not rent out, insure, or provide vehicles, and does not handle payments between members. Amounts shown in settlements are calculations based on the data the members entered; members settle them among themselves (for example by bank transfer) and remain responsible for checking that entries are correct. Members are responsible for complying with the law, their insurance policy, and the vehicle owner's permissions when driving a shared car. Members must only invite people they know and must not enter other people's personal data beyond what is needed to share the car (such as a display name for a person without the app).

Budget and Cost-Tracking Disclaimer

The budget, cost, and "remaining budget" figures shown in the Application are calculated solely from the amounts You manually enter and are provided for Your personal organizational purposes only. They do not constitute financial, tax, insurance, or professional appraisal advice, and the Company makes no representation as to the accuracy of any part prices, vehicle valuations, or projected costs You or third parties enter. You are solely responsible for Your own purchasing, budgeting, and financial decisions related to Your vehicle projects.

Termination

Because the Service does not store Your Project Data on a server, there is no Company-side account for the restoration part for Us to suspend or delete. If You breach these Terms, We may, to the extent technically possible, restrict Your access to Subscription features (for example, by revoking an entitlement obtained fraudulently through RevenueCat/Apple) and suspend or delete Your Car Sharing Account, in particular if You misuse the car sharing part as described in "Car Sharing" above.

You may stop using the Service, sign out, or delete the Application at any time. Deleting the Application from Your Device permanently erases all locally stored Project Data (unless You have exported a backup beforehand). Signing out without deleting the Application does not delete Your Project Data from the Device.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms, and Your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by You through the Service during the twelve (12) months preceding the event giving rise to the claim, or 100 USD if You have not purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of Project Data or photos, or business interruption) arising out of or in any way related to the use of or inability to use the Service, even if the Company has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to You. Nothing in these Terms limits any right You may have under mandatory consumer-protection law that cannot be excluded by agreement.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects, without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Governing Law

The laws of the Country (Germany), excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws. Consumer protection laws of Your country of residence may apply and are not restricted by this clause.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of that provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice before the new Terms take effect. By continuing to access or use the Service after those revisions become effective, You agree to be bound by the revised Terms.
